Terms of Service

By accessing or using the DUBX NFT Marketplace ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. DUBX operates on the HyperPaxeer blockchain (Chain ID: 125) and facilitates the buying, selling, and trading of non-fungible tokens (NFTs) using $PAX and $DUBX tokens.

You must be at least 18 years old or the age of majority in your jurisdiction to use the Platform. By using DUBX, you represent and warrant that you meet these requirements and have the legal capacity to enter into a binding agreement.

You are solely responsible for maintaining the security of your wallet and private keys. DUBX does not hold, manage, or have access to your private keys, seed phrases, or wallet credentials. We are a non-custodial platform — your assets remain in your wallet at all times. You are solely responsible for any activity that occurs through your connected wallet.

All NFT purchases, sales, offers, and trades conducted on the Platform are executed on the HyperPaxeer blockchain and are irreversible once confirmed. You acknowledge that blockchain transactions cannot be undone, reversed, or refunded by DUBX. A platform fee of 2.5% is applied to each transaction, distributed among creators (royalties), $DUBX holders, token burn, and the platform treasury.

You agree not to: (a) use the Platform for any unlawful purpose; (b) upload, mint, or distribute content that infringes intellectual property rights; (c) engage in market manipulation, wash trading, or fraudulent activity; (d) attempt to exploit, hack, or interfere with the Platform's smart contracts or infrastructure; (e) impersonate other users or projects; (f) use automated bots or scripts to manipulate listings, offers, or prices without authorization.

By minting or listing NFTs on DUBX, you represent that you own or have the right to use all content associated with your NFTs. You retain ownership of your original content. DUBX is granted a non-exclusive, worldwide license to display, promote, and distribute your content on the Platform. DUBX reserves the right to remove any content that violates these Terms or applicable law.

$DUBX is the utility token of the Platform used for collection launches, advertising, and governance. Collection launch fees are payable in $DUBX: 40% is permanently burned, 35% is redistributed to $DUBX holders, and 25% goes to the platform treasury. Token values fluctuate and DUBX makes no guarantees regarding the value of $PAX or $DUBX tokens.

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. DUBX does not warrant that the Platform will be uninterrupted, error-free, or secure. DUBX does not endorse, guarantee, or assume responsibility for any NFT, collection, or project listed on the Platform. You assume all risk associated with your use of the Platform and any transactions you conduct.

To the maximum extent permitted by law, DUBX and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to: loss of funds, loss of NFTs, smart contract failures, blockchain network issues, or unauthorized access to your wallet. Our total liability shall not exceed the fees collected from your transactions in the preceding 12 months.

You acknowledge and accept the inherent risks of blockchain technology, including but not limited to: price volatility of digital assets, regulatory uncertainty, smart contract vulnerabilities, network congestion, and the possibility of total loss of funds. Nothing on this Platform constitutes financial, investment, legal, or tax advice. You should consult qualified professionals before making any decisions.

DUBX reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use of the Platform after any modifications constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

DUBX may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately, but any NFTs and tokens in your wallet remain accessible through the blockchain directly.

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration. You agree to waive any right to participate in class action lawsuits against DUBX.

DUBX employs wallet-based identity verification and anti-spam systems to protect all users. Automated systems may restrict wallets engaged in mass messaging, phishing link distribution, or impersonation. Chat link permissions are NFT-gated per project — only verified members may post links within project chats. Creators may configure domain allowlists for their communities. A platform-maintained scam address database tracks and permanently blocks wallets confirmed as malicious. For full details, see our Ban Policy & Offense Tiers page.

DUBX operates a tiered moderation system with platform-level moderators assigned by wallet address. Moderators review reports, manage bans, and enforce community standards. All moderator actions are logged in an immutable audit trail. Users may appeal bans through the formal Appeal Process. Moderators are bound by a separate Moderator Code of Conduct. DUBX reserves the right to ban wallets, remove content, and restrict access to any user who violates these Terms.

DUBX supports user-created groups ("Cabals" or "Clubs") where NFT badges serve as membership cards. Cabal creators set their own rules, pricing, supply limits, and whitelist requirements. DUBX is not responsible for the actions, promises, or conduct of individual cabal creators or members. Membership NFTs may be time-gated (expiring) or permanent, as determined by the creator. All cabal activity is subject to these Terms and the Platform's community standards.
